5 Unusual opportunity for good ear Indians driven from pork plant in South Dakota WAGNER, S.D. (AP) South Dakota Atty. Gen. William Janklow directed a tear-gas barrage that ended a 16-hour takeover by armed Indians of a meat plant here. When it was over, be said federal policy dealing with such disturbances is a failure because the state always winds up doing the federal government's work.

Seven heavily armed Indian militants took control of the Yankton Sioux Industries Pork Plant early Friday and held it until state Highway Patrol officers and Bureau of Indian Affairs police flushed them out with tear gas Friday night. All seven were arrested, but no charges were filed against them immediately. The militants held two employes of the plant for a brief period, but were released with minor injuries. There was sporadic gunfire from the plant after the occupation, but authorities said there were no injuries. Janklow said the car of plant manager Melvin Rosenthal, who was forced from the plant at gunpoint early Friday, was hit by gunfire.

Janklow said none of the state and federal law officers surrounding the plant returned fire. An American Indian Movement-affiliated arm of the Yankto Sioux Tribe, calling itself the Eagle Warrior Society, held the plant for three days in mid-March, protesting working conditions there. Hamilton named Land Bank head Steven Hamilton, vice president of the Mason City Federal Land Bank Association, has been promoted to president of the Federal Land Bank Association of Mount Pleasant, Iowa, effective May 12. Hamilton is a native of the Hampton area. He began his Land Bank career in James S.

Suspension hearing set Globe-Gaiette News Service KANAWHA A hearing will be held before the Kanawha School Board Tuesday night at which time attorneys will argue the knotty case of James Van Hove, a high school junior. A bearing was to have been held in Hancock County District Court Friday afternoon but the attorneys decided to go before the School Board instead.

Van Hove was suspended from school Wednesday morning of last week. His torney, Earl Hill of Britt, said it was in violation of the law because the student was suspended by High School Principal Gary L. Yocum for a longer time than for which he had authority. Although a high school prinicpal has the right under Iowa law to "suspend temporarily," this amounted to expulsion in Hill's opinion. Section 282.4 of the Iowa Code says; "The board may, by a majority vote, expel any scholar from school for immorality, or for a violation of the regulations or rules established by the board, or when the presence of the scholar is detrimental to the best interests of the school; and it may confer upon any teacher, principal, or superintendent the power temporarily to dismiss a scholar, notice of such dismissal being at once given in writing to the president of the board." A letter from Yocum said Van Hove was suspended from all school activities, could continue to do class work at home in order to graduate and had a right to a hearing.

Hill says the letter sets no time for a hearing. And there was no termination date, he said. The letter "just said Hill declared. School officials contend the high school prinicpal, by law, has the right to suspend. And this suspension was only to extend to the time the School Board which by law has the right to "expell" -could meet and decide the matter.

School officials contend the suspension was for 22 days. Hill says it's customary, at least in Britt, to suspend a student for no more than three days. A week ago Friday, Hill filed a writ of injunction in District Court, which was granted by Judge John Stone. Van Hove was able to return to classes that afternoon. This was in time for the junior-senior prom that evening, which Hill said was the reason for the injunction.

Van Hove, according to Supt. LeRoy Scharnhorst, was suspended because, "We felt he was interferring with the educational process." Scharnhorst, In his first year as superintendent, said Van Hove had passing grades the first semester. "He probably could be on the honor roll," said the superintendent. Yocum, citing reports from teachers, told the Globeiazette Van Hove was "continuously disruptive" in class. What form the hearing will take is to be worked out yet.

The five-member board is presided over by Dr. L. L. Henning, Kanawha veterinarian. Hill, met Friday with Andrew Schill of Fort Dodge, the School Board's attorney.

The car was lost, said Iowa Highway Patrolman David Hubbard of Garner, who noted the top was smashed. "They were very lucky to come crawling out," said Hubbard, who arrived minutes after the mishap. Cartel received a cut hand when he broke a window to get out of the overturned vehicle. He was also charged with failure to have control.
